EXPERIENCER AGREEMENT & POLICIES

 

PLEASE READ CAREFULLY BEFORE BOOKING YOUR TRIP WITH BGTT

Welcome to BGTT! We’re so excited to have you join the BGTT Family as an Experiencer & for you to come along for the most impactful experience of your LIFE! Before we can begin planning for our adventures together, please take the time to review this Experiencer Agreement & sign electronically, demonstrating your agreement. AGREEMENT

1.1 Parties. The following parties, (“Experiencer”, if left blank, the individual completing this purchase) and DRM Group Management, LLC  (“/DBA/ Black Girls Travel Too, /AKA/ BGTT”) enter into this Agreement.

By purchasing an experience/trip, Experiencer acknowledges BGTT’s policies and agrees to abide by them within the scope of this Agreement.

1.2 Scheduled Experience Details. Experiencer has selected a Scheduled Experience (“Scheduled Experience”) offered via BGTT. You understand that, once selected, this selection cannot be changed or transferred to a different destination or date of Experience.

 PAYMENT

 2.1 Investment. Experiencer agrees to pay the entirety of the total fee stated at the time of reservation. All fees are stated and paid in US Dollars.

2.2 Payment Plan. Experiencer may select a payment plan at the time of reservation and agrees to remit all installment payments as agreed upon in the payment terms.

2.3 Payment Schedule. If Experiencer selects a payment plan, Experiencer agrees to satisfy their balance in full no less than sixty (60) days prior to the start of the Scheduled Experience. Should Experiencer fail to submit the final payment 60 days out, a 3% late fee will be assessed each day based on the outstanding amount.

If Experiencer fails to submit payment in full by forty-five (45) days prior to the date of arrival, BGTT reserves the right to cancel booking and retain 100% of funds paid.

Company will notify Experiencer in writing of the billing dates & frequency of the scheduled payments.

2.4 Credit Card Payment/Processing. BGTT uses a third-party credit card processing company to provide Experiencer with a convenient way of submitting payment. Experiencer agrees to update Company’s records in the event that Experiencer’s credit/debit card/bank account is closed, expires, or is no longer active for whatever reason. Experiencer may contact BGTT directly to provide updated payment information: support@blackgirlstraveltoo.com

2.5 Declined Payment. In the event that payment is attempted by BGTT and is subsequently declined, Company will provide Experiencer with a courtesy email notifying Experiencer of the declined payment method. If the past due payment is not paid within five (5) business days of its due date, there will be a 3% late fee assessed for that payment installment.

If payment has not been submitted within seven (7) business days of the payment due date, BGTT reserves the right to cancel Experiencer’s booking and & retain all paid funds.

In the event of non-payment, payment disputes, or chargebacks, BGTT reserves the right to refer Experiencer’s account and outstanding balance to the collections agency of its choice, with Experiencer agreeing to bear all costs, including reasonable attorney’s fees, associated with such an event.

REFUND, CANCELLATION, & DISPUTE POLICIES

Part of BGTT’s responsibility is organizing the activities, accommodations, and transportation that will make your Experience the experience of a lifetime. We not only host our Experiencers during the Experience, but also do the work necessary ahead of time to make sure that everything is in place and ready for you.

Experiencer understands that coordination of the Scheduled Experience requires such planning to take place months in advance. For this reason, the following policies apply:

3.1 Cancellations. In the event that an Experiencer attempts to cancel its commitment to attend the Scheduled Experience, BGTT reserves the right to retain 100% of all paid funds. Experiencer agrees to not file a dispute or chargeback through their bank and to instead utilize their mandatory travel insurance in the event that Experiencer can no longer attend the Scheduled Experience.

3.2 Refund Policy. Experiencer may receive a 100% refund (less any processing fees) within seven (7) days of purchasing the Scheduled Experience, so long as that at the time of expiration of those seven (7) days the Scheduled Experience start date/Date of Arrival is more than six (6) months away.

BGTT is unable to offer any refund after expiration of the seven (7) days following booking/payment. You understand that any fees paid for the Scheduled Experience are non-refundable by BGTT.

Due to the nature of these services, BGTT is unable to provide any refunds post-Experience. We value feedback from Experiencers & welcome them to share any comments or suggestions with us here: hello@blackgirlstraveltoo.com.

3.3 Payment Disputes. Regardless of the reasoning behind a refund request, Experiencer agrees to not file a payment dispute or chargeback through their bank/financial institution under any circumstance, and to instead utilize her travel insurance in the event that she can no longer attend the Scheduled Experience or otherwise desires a refund/expense reimbursement.

Experiencer agrees to not file a chargeback in violation of BGTT’s Refund Policy. In the event that a chargeback is requested and/or processed, Experiencer agrees to repay BGTT for the full amount and be responsible for any fees incurred in recouping payment, including attorney’s fees and fees associated with collections efforts.

3.4 Gift Cards. Occasionally, BGTT may offer a promotion which offers Experiencers the opportunity to receive a gift card of a specific amount. Experiencer agrees to return said gift card or remit payment equal to the value of the gift card in the event that Experiencer cancels their reservation within the cancellation period or prior to the Scheduled Experience.

TRAVEL INFORMATION

4.1 Passport and Travel Documents. Experiencer is responsible for securing a valid passport. Upon signing up to attend a Scheduled Experience, Experiencer will send via e-mail a photocopy of their passport, displaying the expiration date. Ninety (90) days prior to the Date of Arrival, Experiencer will send an updated copy of their passport.

Some destination countries require a tourist visa to be secured before entering the country. Experiencer understands that it is their responsibility to secure the visa and will do so at the time of purchasing Experiencer’s airline ticket(s).

If a visa is required for your Scheduled Experience, Experiencer agrees to purchase her airline ticket and obtain a visa within thirty (30) days of booking their Experience. 

It is the responsibility of the Experiencer to ensure that there are adequate amounts of passport and visa pages within their passport booklet, in accordance with the requirements of the Scheduled Experience destination. BGTT will not be liable in the event that Experiencer fails to ensure that Experiencer’s travel documents are in order.

4.2 Travel Insurance. Each Experiencer is required to purchase a travel insurance policy within fourteen (14) days of booking their Scheduled Experience. The insurance policy must include a minimum of $100,000 of coverage and should cover, at minimum, Emergency Transportation/Evacuation and Trip Cancellation Protection in the amount of the Scheduled Experience costs, Lost Bag, 24/7 Hotline Assistance, Epidemic/Pandemic Cancellation, Medical Coverage, including if you become impacted by COVID-19 before and during. Experiencer agrees to provide BGTT with a digital copy of their travel insurance policy via email within fourteen (14) days of booking their Experience.

BGTT may provide a list of travel insurance providers to the Experiencer as a courtesy or upon request. BGTT does not provide any guarantees as to the coverage or service provided by these insurance agencies.

Experiencer understands and agrees its remedies exclusively include filing a claim under this insurance policy in the event that they are unable to attend the Scheduled Experience, due to Experiencer’s fault or otherwise, or incurs any other loss related to the Scheduled Experience.

4.3 Purchase of Airline Ticket. Experiencer is responsible for purchasing their airline ticket to the origination city of the Scheduled Experience (unless otherwise noted in writing) as well as any airline ticket necessary for departure at the end of the Scheduled Experience. BGTT is not responsible for any delays caused by the airline, missed flights due to Experiencer error, or otherwise.

Experiencer agrees to purchase their airline ticket as soon as possible, no later than 120 days prior to the Date of Arrival. Experiencer will provide BGTT with a digital copy of their airline reservation at least 120 days prior to the Date of Arrival.

One (1) week prior to the Date of Arrival, Experiencer will provide an updated digital copy of their travel itinerary to BGTT via email.

In the event that Experiencer arrives prior to the Scheduled Experience Date of Arrival, neither accommodations nor transportation from the airport will be provided by BGTT. BGTT will provide Experiencer with a window of time (based on local time) during which transportation will be provided as part of the Scheduled Experience, as outlined below.

4.4 Transportation. BGTT is responsible for arranging transportation during the Scheduled Experience for BGTT-coordinated activities. BGTT will also arrange transportation to and from the airport on the Date of Arrival and Date of Departure in three shifts: early morning, mid-morning, and mid-afternoon. In the event that this schedule does not fit within the Experiencer’s arrival or departure, Experiencer is free to arrange transportation for themselves at their own expense.

4.5 Accommodations. BGTT will provide accommodations for the duration of the Scheduled Experience. Should Experiencer decide to arrive early or stay after the Scheduled Experience,

Experiencer will be responsible for their accommodations, as well as any other expenses or meals costs, on those days/nights.

All Experiencers will be assigned shared accommodations with fellow Experiencer(s). Depending on the location, BGTT may make available single-occupancy accommodations for Experiencers to reserve. Availability of such accommodations is not guaranteed. Any single-occupancy accommodations made available are to be reserved at an additional cost. Experiencer understands that such accommodations are on a first-come first-serve basis.

Requests for single-occupancy reservations must be made at the time of booking or by any other deadline communicated by BGTT. If no single-occupancy accommodations (if available) are requested in a timely manner by Experiencer, Experiencer agrees to the assigned standard shared accommodations by default.

In the event that Experiencer wishes to indulge in room service, services provided on-site at the hotel (if applicable), or otherwise incurs expenses or causes some kind of damage to their room/accommodations, Experiencer understands that they are solely responsible for any and all extra charges to her room/account and agrees to settle such balances prior to departure.

In the event that Experiencer fails to settle such charges prior to departure, Experiencer agrees to indemnify BGTT in any situation of property damage or fees that remain unpaid. Experiencer grants permission to BGTT to charge any unpaid expenses to the card on file belonging to Experiencer.

In the event that BGTT must pursue unpaid fees/damages from Experiencer, Experiencer will be responsible for all expenses associated with securing such payment, including attorney’s fees and/or fees associated with collections efforts.

In the event that Experiencer elects to not stay at the BGTT-provided accommodation at any point during an Experience, Experiencer is free to independently arrange for alternative accommodations, however, such a situation does not warrant a refund or discount of any kind, partial or otherwise. Experiencer also understands that BGTT is not responsible or liable for any situation related to independently-made accommodation arrangements. BGTT will not provide transportation to or from such accommodations.

4.6 False Representation. At no time shall Experiencer make representations, directly or indirectly, to vendors, accommodations, administrators, or any other individual/company that Experiencer is somehow affiliated with BGTT or DRM Group Management LLC in an authoritative, management, or administrative role. This includes but is not limited to requesting official files, records, and/or information on accommodations, bookings, excursions, etc. from vendors, etc., in written form or otherwise.

EXPERIENCE POLICIES

5.1 Included in the Scheduled Experience:

o   Housing accommodations. Accommodations may be in the form of a hotel, short-term rental/Airbnb, hostel, villa, condo, homestay, or any combination of these.

o   Select meals. Meals included in the Experience can be viewed on the Scheduled Experience Itinerary provided to Experiencer. Any meals/snacks/beverages outside of these meals are the responsibility of the Experiencer.

o   Planned excursions. These activities can be viewed on the Scheduled Experience Itinerary provided to Experiencer by BGTT. Any activities/excursions outside of these are the responsibility of the Experiencer.

o   Transportation. Round-trip airport transport (arrival & departure), as stated in Section 4.4, as well as to and from excursion sites, as specified in the itinerary.

o   Travel Guide. A BGTT Travel Ambassador will be made available to Experiencer. BGTT’s Travel Ambassador will accompany Experiencers as a guide for all itinerary activities.

o   Please note that gratuity/tips to on-site service providers are not included in the Scheduled Experience.

5.2 Communication. BGTT’s Travel Ambassador will communicate with Experiencers on the Scheduled Experience via an electronic messaging program such as Whatsapp or Slack Chat. Experiencer will be notified of the messaging program of choice before the Scheduled Experience and will be added to a group forum/chat which will be used for text communications throughout the Scheduled Experience. Experiencer agrees to maintain the designated mobile application on their phone and remain a member of the group forum for the duration of the Scheduled Experience, as this will be the sole and designated method of electronic communication with the group.

5.3 Excursions. BGTT crafts custom excursions for its Experiencers to participate in. In the event that a planned excursion is canceled, BGTT will make reasonable efforts to substitute the excursion with another planned activity or reschedule for a different day of the Experience. Circumstances outside of BGTT’s control do not give rise to a breach or refund, partial or otherwise.

Should Experiencer decide to opt out of an excursion, or if Experiencer is not able to participate in the activity/excursion, Experiencer understands that this does not entitle Experiencer to a refund, partial or otherwise.

By participating in any and all excursions, Experiencer acknowledges that Experiencer does not have any physical limitations, medical ailment, physical or mental disabilities that would limit or prevent that Experiencer from participating in the excursions. If necessary, Experiencer will obtain a medical examination and clearance to participate in said excursions.

Experiencer releases BGTT from any liability stemming from personal property loss, injury, and/or death that Experiencer may sustain while participating in the Scheduled Experience and/or its excursions.

In the event that an Experiencer is late to an excursion, BGTT, the on-site Travel Ambassador, and/or the rest of the Experiencers are not required to wait or delay the excursion. Refunds, partial or otherwise, will not be provided for any such absence. Should the Experiencer not arrive in time to take BGTT transportation to the excursion, they will be required to secure transportation to the excursion at their own expense, without reimbursement by BGTT.

5.4 Experiencer Emergency Contact Information.

Experiencer agrees to provide BGTT with Emergency Contact Information for at least one (1) individual, including their name, relationship to Experiencer, phone number, and email address.

5.5 Luggage. Experiencer is responsible for bringing with them everything they need for purposes of travel. The hosting hotel, villa, hostel, Airbnb, etc. may provide items like shampoo, body wash, etc., however, BGTT does not guarantee any personal care or travel items to be available at the Scheduled Experience destination or accommodations.

BGTT is not responsible for the loss of or damage to luggage en route to the destination, at the time of departure, or for the duration of the Scheduled Experience.

5.6 Alcohol Consumption. Experiencer agrees to engage in the consumption of alcohol in a reasonable manner and not to the point of becoming belligerent, violent, or detrimental to oneself, others, physical property, and/or the overall Experience. Experiencer agrees to not, under any circumstances, operate any motor vehicle while under the influence of alcohol.

5.7 Illegal Activity. Experiencer agrees to abide by the destination’s local, state, and federal laws and will refrain from engaging in any criminal activity, including but not limited to the possession, purchase, or consumption of illicit substances. Engaging in such behaviors will be considered as grounds for ejection.

In the event that an Experiencer is incarcerated in the destination country, BGTT is under no obligation to provide bail money or otherwise. BGTT will make reasonable attempts to notify the emergency contact provided by Experiencer.

5.8 Social Media and Online Forums. Experiencers are encouraged to share their Experience with the world. (If Experiencer chooses to do so, we’d love to be tagged on social media!) Experiencer agrees to not publish any harmful or disparaging comments, posts, or photos with respect to BGTT, the host destination, as well as fellow Experiencers. This provision does not limit Experiencer from sharing honest reviews or testimonials.

5.9 Guests. We at BGTT encourage socializing and immersion into the local society. However, it is against BGTT policy to bring non-Experiencer guests to the BGTT-provided accommodations. Experiencer agrees to not bring guests (regardless of gender) to the accommodations for the duration of the Scheduled Experience. Doing so will be considered grounds for ejection at BGTT’s sole discretion.

5.11 Additional Travelers/Guests. Experiencer agrees to not bring along any additional travelers that are not pre-approved by BGTT. Doing so will be considered as grounds for ejection at BGTT’s sole discretion.

5.12 Romantic/Intimate Relationships. Experiencer agrees to not seek or pursue romantic relationships with any BGTT vendors, local partners, or other Experiencers for the duration of the Scheduled Experience. Doing so will be considered as grounds for ejection at BGTT’s sole discretion.

5.13 GROUNDS FOR EJECTION. BGTT’S PRIORITY IS TO MAINTAIN A SAFE, ENJOYABLE EXPERIENCE FOR ALL EXPERIENCERS. BGTT RESERVES THE RIGHT TO REMOVE AND/OR EXCLUDE ANY EXPERIENCER FROM THE SCHEDULED EXPERIENCE IN THE EVENT THAT EXPERIENCER’S BEHAVIOR IS DEEMED DANGEROUS OR POSES A DANGER TO OTHERS. OTHER GROUNDS FOR TRIP EJECTION INCLUDE INTENTIONALLY DAMAGING OR DEFACING PROPERTY, FIGHTING, USAGE OF ABUSIVE LANGUAGE, INAPPROPRIATE AND/OR DISRESPECTFUL TREATMENT OF BGTT STAFF, FELLOW EXPERIENCERS, VENDORS, TOUR GUIDES, AND/OR LOCALS WITHIN THE DESTINATION. EJECTION WILL BE AT THE EXPERIENCER’S EXPENSE AND DOES NOT ENTITLE EXPERIENCER TO ANY REFUND.

In the event that an Experiencer is ejected, BGTT will provide an ejection notice electronically in writing. If accommodations are shared, the ejected Experiencer will no longer be able to remain on the accommodations premises, nor will the ejected Experiencer be permitted to participate in group activities, including excursions and transportation.

5.14 Liability. In the event that Experiencer sustains a loss of personal property during the duration of the Scheduled Experience, BGTT maintains no liability and will not be held responsible for any such loss. In addition, BGTT maintains no liability in the event that physical injury and/or death occurs during an Experience, absent any gross negligence on the part of BGTT and its representatives.

5.15 COVID-19 and Other Illnesses: In light of the changes made due to COVID-19, some destinations may require testing prior to arrival. Experiencer agrees and understands that, if required, providing such test results, including all fees associated with such testing, is the sole responsibility of Experiencer. You understand that in the event that you, as an Experiencer, are refused entry by the authorities of a destination, you are not entitled to any refund from BGTT and as the Experiencer, you bear all responsibility for all expenses related to your travels and/or return expenses. You agree to leverage your mandatory travel insurance policy in the event that such financial support is needed.

You, as the Experiencer, agree to release BGTT from any and all liability in the event that you were to contract any illness or disease, including but not limited to Coronavirus, COVID-19, including any variant, while participating in the Scheduled Experience or in travel to or from the destination.

Hospitalization. In the unlikely event that an Experiencer is hospitalized, BGTT is not liable for any medical or other fees associated with any treatment, accommodations, or extended stay by the Experiencer. BGTT agrees to make every reasonable effort to contact the Experiencer’s emergency contact in order to notify the emergency contact of Experiencer’s circumstances. Experiencer agrees and understands that BGTT and its representatives are not required to remain in the destination for any period of time or to accompany Experiencer in the event of hospitalization or illness.

5.16 Local Emergencies. BGTT is unable to anticipate local emergencies and/or political climate changes in destination countries. In the event that an emergency arises, the BGTT Travel Ambassador will provide Experiencers with information via the designated group messaging mobile application. Experiencer agrees to record the local U.S. Embassy information in their mobile device and will travel to the U.S. Embassy in the event that an emergency situation arises.

5.17 Local Recommendations. During the Scheduled Experience, the BGTT Representative/Travel Ambassador may make recommendations on restaurants, shopping locations, etc. per Experiencer’s request. BGTT cannot provide any guarantees as to the service or quality of any local businesses, vendors, or service providers, recommended by a Travel Ambassador or otherwise.

MISCELLANEOUS

6.1 Electronic Signature. Experiencer understands that under law, signatures transmitted digitally and created electronically via touchscreen or computer mouse shall have the same force and binding effect as an original handwritten signature in ink.

6.2 Authorization. BGTT may hire a local photographer to capture snapshots of your Experience. Experiencer expressly and irrevocably authorizes the use of his or her likeness for commercial purposes by the Company as well as its assignees, licensees, legal representatives, and transferees, unless otherwise agreed to in writing. This authorization permits for the publication and use of any and all photographs, pictures, portraits, videos, and/or images in any and all forms and media including for purposes of illustration, commercial art, publishing, advertising, promotion, publicity, social media and other electronic forms, for any products or services, or other lawful uses as may be deemed appropriate by the Company in the course of its business.

6.3 No Modification. Parties agree that there shall be no changes to this Agreement – unless in writing, agreed to, and signed by both parties.

6.4 Force Majeure. BGTT may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of Company that materially affects the Services provided in this Agreement, including but not limited to:

  1. A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms, or infestation); or
  2. War, invasion, act of foreign enemies, embargo, or other hostility (whether declared or not); or
  3. Any hazardous situation created outside the control of either party such as a riot, disorder, pandemic or epidemic, nuclear leak or explosion, or act or threat of terrorism.

In the event that this Section applies, BGTT will be permitted to make a reasonable effort to reschedule Experiences as needed in order to comply with the terms of this Agreement, however, will not be found in breach if this is not possible due to the circumstances. Refunds will not be provided by BGTT and should be sought via Experiencer’s travel insurance policy. BGTT may provide a credit to Experiencer to be applied towards a future BGTT Experience.

Experiencers affected by this section 6.4 agree to seek reimbursement for expenses paid and/or incurred exclusively through the required travel insurance policy held by Experiencer. Purchase of such a policy is mandatory upon purchase of a BGTT Experience. Failing to purchase the necessary insurance policy is considered a material breach of this agreement.

6.5 Transferability. Experiencer cannot transfer this Agreement or Experience to any other entity or individual. Any potential transfer may only take place with the written permission of BGTT.

6.6 Warranties. BGTT does not guarantee or provide any warranty, express or implied, with regards to any specific results or experience in connection with the Scheduled Experience.

6.7 Governing Law. The laws of the state of Texas will govern the validity, construction, and performance of this contract. Any actions relating to this contract will be handled in courts or providers serving Tarrant County, Texas.

6.8 In the event of a dispute, the first course of action to be sought by Experiencer, after making a good-faith and reasonable effort attempting to resolve the matter amicably, shall be mediation with a mutually agreed upon mediator.

By entering into this Agreement, you are relinquishing the right to bring or participate in a class action lawsuit against BGTT or its representatives. Neither you nor we may be a representative of other potential claimants or a class of potential claimants in any dispute, nor may two or more individuals’ disputes be consolidated or otherwise determined in one proceeding. While the prohibition on consolidated or class-wide proceedings in this Agreement will continue to apply if you fail to timely pay amounts due, we may assign your account for collection and the collection agency may pursue such claims in court limited strictly to the collection of the past due debt and any interest or cost of collection permitted by law or the Agreement.

6.9 BGTT will do its due diligence prior to confirming official reservation of the Experiencer’s spot on the Scheduled Experience. BGTT reserves the right to cancel reservation(s) at any time within seven (7) days of initial payment, for any reason.

Wherever possible, each provision of this contract will be interpreted so that it is valid under applicable law. If any provision is held illegal or unenforceable, that provision will be reformed to the extent necessary to make the provision legal and enforceable. All remaining provisions will remain unaffected and will continue in full force and effect.

Experiencer has the opportunity to seek independent legal advice prior to signing this Agreement. Experiencer acknowledges and agrees that Experiencer has carefully read this Agreement, that Experiencer understands and is voluntarily executing this Agreement.

The parties have executed this Agreement on the date of purchase. The Experiencer’s electronic signature and the initial payment constitute our Agreement.
